Digital Goods & Licensing Disclosure — Photo Booth FX (“PBFX”)

This page explains what you are buying, what you can do with PBFX digital products (prompts, presets, templates, downloadable files), and what you cannot do. It applies to all PBFX digital items unless a product page or written agreement says otherwise.

1) Licensed, not sold
When you purchase PBFX digital items, you are buying a license to use them—not ownership of the underlying intellectual property. PBFX (or our licensors) keeps all IP rights in the source files, prompt logic, templates, and documentation.
Your outputs (images, graphics, files you generate using our items) are yours to use as described below, subject to third-party rights and model/platform terms.
2) Default license (what you can do)
Unless a product page grants a different license, your purchase grants a non-exclusive, non-transferable, non-sublicensable license to:
Create unlimited outputs for yourself and for your end clients.
Use outputs commercially (web, social, ads, print, event deliverables, portfolios, pitch decks).
Edit outputs (crop, color, retouch, composite) and combine with other assets you own or license.
Install and use the purchased prompts/presets/templates on devices you personally control for your business.
Share outputs with clients as deliverables (JPEG/PNG/MP4/PDF, etc.).
Attribution: Not required. Appreciated where practical.
3) Prohibited uses (read carefully)
The following are never allowed unless you have PBFX’s prior written consent:
Resale or sharing of source files
Do not resell, share, trade, publish, or gift PBFX prompts, presets, templates, or any source files.
Do not include them in “prompt libraries,” preset bundles, or training courses.
Reverse engineering
Do not attempt to reconstruct PBFX prompts or internal logic from outputs, metadata, or UI settings.
Do not publish “equivalents,” “translations,” or derivative prompt packs based on PBFX materials.
AI model uses
Do not use PBFX content or outputs to train, fine-tune, evaluate, fingerprint, or extract features for any model or dataset.
Do not harvest PBFX content for embeddings or retrieval systems.
Sublicensing or transferring
Licenses are for you/your business only. Do not sublicense or transfer to agencies, vendors, or other creators.
If your client needs direct access to our prompts/templates, they must purchase their own license from PBFX.
Unlawful or high-risk uses
No uses that violate others’ rights (privacy, publicity, copyright, trademark), or applicable platform/model rules.
No uses that depict or target minors in unsafe contexts. Follow platform safety rules strictly.
Breach: Violating these terms may terminate your license automatically and may result in legal remedies.
4) Seats, teams, and agencies
Single-User / Single-Business License (default): One license covers one person within one business using the files on their devices.
Teams: Each active creator who uses PBFX source files needs a seat (additional licenses).
Contractors: External editors may handle outputs you produced, but may not use PBFX source files unless they hold a license.

5) Exclusivity (if offered)
Most PBFX products are non-exclusive. If a product page or order form offers exclusive or limited licenses, the terms will specify scope, duration, territory, and deliverables. Exclusive arrangements require a separate written agreement and may include store removal commitments and version hashing.
6) Subscriptions and updates (if offered)
If a product is sold by subscription, access and updates are provided during the active term. When a subscription ends, access to gated libraries or update channels may cease. Keep local backups of downloads you are permitted to retain.
7) Model & platform terms still apply
PBFX products may be used within third-party tools (e.g., AI image generators, editing suites). Those tools have their own terms, licenses, and acceptable-use policies. Your rights to use outputs may also depend on the model/platform’s rules. You are responsible for complying with those third-party terms.
Logos & trademarks: If you generate outputs showing brand logos or trademarked marks, you are responsible for obtaining any necessary permissions from the rights holder.
8) Refunds and right of withdrawal (summary)
Digital content: Access is delivered immediately; all sales are final once you access or download.
EU/UK: Distance-selling cooling-off does not apply once you give express consent to start digital delivery and acknowledge you lose the right to withdraw.
If files are defective/misdescribed: Contact us within 14 days; we’ll repair/replace or refund if we cannot remedy.

9) Security & anti-abuse
We implement rate-limits, unique file fingerprints, and other measures to protect our IP and our customers. Do not attempt to bypass security, redistribute links, or scrape protected content.
10) Examples (for clarity)
Allowed
Use a PBFX prompt to generate 200 branded images for a corporate event client and deliver JPGs.
Edit outputs in Photoshop and deliver print-ready posters.
Hire a retoucher to polish your outputs (they work on the outputs, not the PBFX source files).
Use the same prompt pack across multiple jobs for your business.
Not allowed
Upload PBFX prompts/presets to a shared Google Drive for a freelancer network.
Rebuild and sell a “PBFX-style” prompt pack derived from our outputs or documentation.
Feed PBFX content or outputs into a training dataset, embedding index, or feature extractor.
Transfer your license to a new studio when you change employment.
11) Definitions
Digital Goods: PBFX prompts, presets, templates, and downloadable files.
Outputs: Media generated using Digital Goods (e.g., images, composites, renders, exports).
End Client: The customer for whom you create outputs.
Seat: One human user who can access and use PBFX source files.
Reverse Engineering: Any attempt to deduce PBFX proprietary prompts, structure, weights, or logic from outputs, metadata, or UI artifacts.
Model Training / Feature Extraction: Any process that uses PBFX content or outputs to develop, test, evaluate, or fingerprint AI systems or datasets.
12) Changes
We may update this Disclosure to reflect product or legal changes. The “Last updated” date shows when revisions took effect. For material changes, we may also post a notice or email customers.
