Terms of Service - Photo Booth FX ("PBFX")

These Terms of Service ("Terms") are a contract between you and Photo Booth FX ("PBFX," "we," "us," or "our"). These Terms govern your access to and use of PBFX websites, applications, hosted event microsites, digital galleries, AI photo booth experiences, account features, and any other products or services we make available that link or refer to these Terms, including pbfx.ai, app.pbfx.ai, and related event pages or hosted experiences (collectively, the "Services").
By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Eligibility and Authority
You must be at least 13 years old to use the Services unless a higher age is required by applicable law.
If you use the Services on behalf of a business, school, nonprofit, event organizer, or other entity, you represent that you have authority to bind that entity to these Terms.
If you are a parent, legal guardian, school official, district representative, teacher, event organizer, or other authorized adult permitting a minor to participate in an event experience using PBFX, you are responsible for ensuring that any required notices, permissions, and consents are obtained.
2. What PBFX Provides
PBFX provides software and hosted experiences for AI photo booth and related event media services, including, where offered:
event microsites
public or private event galleries
AI-generated image experiences
photo capture, upload, transformation, delivery, and sharing workflows
operator dashboards and administrative tools
branded or co-branded experiences
personal gallery claim or retrieval tools
hide, remove, or visibility-control features
email delivery, magic link access, or similar recovery tools
Some features may not be available for every event, account, or deployment.
3. Accounts, Access, and Security
You are responsible for maintaining the confidentiality of your login credentials and for activity under your account.
You agree to provide accurate information when using the Services, including when entering an email address to access a gallery, receive a magic link, or retrieve photos.
We may suspend or restrict access if we reasonably believe an account, event, or feature is being misused, accessed without authorization, or used in violation of these Terms.
4. Important Notice About Event Galleries and Photo Visibility
This section is important.
Depending on how an event is configured, photos and AI-generated images created through PBFX may be:
visible only to the individual participant
visible to the event host or operator
accessible through a private or semi-private event gallery
accessible through a public or link-accessible gallery
shared by the participant, host, or operator through a direct URL, QR code, email, or event page
Not all galleries are private. Some event galleries may be public, discoverable by link, or viewable by other event participants or guests, depending on the event configuration selected by the host or operator.
By using the Services at an event, you understand that your content may appear in the applicable event gallery or hosted experience consistent with that event's settings.
If a Hide My Photo, removal, opt-out, or similar feature is made available for a given event, you may use that feature to request that your image no longer appear in the gallery or public-facing event experience. If no self-service hide feature is available, you may contact us using the contact information below, and we may coordinate with the event host or operator as needed.
We do not guarantee immediate removal in all cases, but we will use commercially reasonable efforts to honor valid removal or visibility requests consistent with applicable law, contractual obligations, event settings, and technical limitations.
5. Claiming a Personal Gallery
If enabled for a particular event or experience, PBFX may allow you to claim, retrieve, or access a personal gallery by entering an email address, receiving a magic link, or using another authentication method.
You may only claim or access content that belongs to you or that you are authorized to access.
You may not impersonate another person, use another person's email address without authorization, or attempt to obtain access to someone else's gallery, photos, or event content.
We may deny, revoke, or limit personal gallery access if we believe access is unauthorized or abusive.
6. User Content and AI-Generated Content
For purposes of these Terms, "User Content" includes any photos, selfies, uploads, prompts, text, metadata, submissions, reviews, or other content provided to the Services. "Generated Content" includes AI-generated or AI-edited images or other outputs created by or through the Services.
You represent that you have the necessary rights, permissions, and authority to submit User Content to the Services.
You retain ownership of your User Content, subject to the rights you grant below.
You understand that Generated Content may be influenced by your User Content, prompts, event settings, templates, overlays, or other system logic. PBFX does not guarantee that Generated Content will meet your expectations or perfectly preserve every feature, style preference, or source detail.
7. License You Grant to PBFX
You grant PBFX a nonexclusive, worldwide, royalty-free license to host, store, reproduce, process, adapt, display, transmit, and use your User Content and Generated Content as reasonably necessary to:
operate and provide the Services
generate and deliver outputs
host galleries and event experiences
enable sharing and retrieval features
maintain service quality, safety, moderation, logging, and support
enforce these Terms
improve and administer the Services
If you are an event organizer, operator, or customer configuring an event experience, you represent that you have obtained any permissions reasonably necessary for PBFX to provide the event as configured.
Except where you separately and expressly agree, this license does not grant us the right to sell your personal photos as stock media or claim ownership of your underlying User Content.
8. PBFX Intellectual Property and Restrictions
The Services, including the software, workflows, interfaces, prompts, prompt structures, logic systems, branding, design elements, templates, overlays, code, documentation, and related materials, are owned by PBFX or our licensors and are protected by intellectual property laws.
Except as expressly permitted by us in writing, you may not:
copy, distribute, sublicense, sell, or create derivative works from the Services
reverse engineer, decompile, disassemble, or attempt to reconstruct PBFX system prompts, prompt logic, workflows, or proprietary syntax
use PBFX content, prompts, outputs, images, or datasets to train, fine-tune, evaluate, fingerprint, or benchmark AI or machine learning systems
scrape or harvest galleries, event pages, user content, or generated outputs
remove copyright, trademark, or proprietary notices
circumvent access controls, privacy controls, event visibility settings, or security features
access or attempt to access another person's gallery or event content without authorization
9. Publicity, Sharing, and Event Operator Responsibility
If you are an event host, organizer, operator, school, district, business, or nonprofit using PBFX for an event, you are responsible for:
selecting appropriate privacy and gallery settings
providing any required participant notices
obtaining any permissions or releases you choose or are required to obtain
complying with applicable laws, school rules, district requirements, or venue rules
using PBFX in a way that is appropriate for your audience, including where minors are involved
PBFX is a technology platform and hosted service provider. We are not your legal advisor and do not guarantee that your chosen event configuration satisfies your independent notice, consent, or release obligations.
10. Minors, Schools, and Youth Events
PBFX may be used at school, family, nonprofit, or youth-oriented events only where the responsible adult, school, organization, district, event host, or authorized representative has determined that the experience is appropriate and has obtained any required permissions or consents.
PBFX does not knowingly contract directly with minor children acting on their own behalf.
Where minors are involved, the adult organizer or authorized entity is responsible for:
participant notice
consent and release collection where required
determining whether gallery visibility should be private, limited, or disabled
deciding whether AI transformation features are appropriate for that event
If we learn that content involving minors is being used or displayed in a way that appears unauthorized, unlawful, or inconsistent with our policies, we may restrict, hide, or remove access.
11. Acceptable Use
You agree not to use the Services to:
violate any law or the rights of others
upload content you do not have rights to use
infringe privacy, publicity, copyright, trademark, or other rights
access accounts, galleries, or images without authorization
interfere with or disrupt the Services
upload malware or malicious code
harass, abuse, impersonate, defraud, or mislead others
use the Services in a deceptive, exploitative, or harmful manner
use the Services to create unlawful, abusive, or rights-violating content
We may remove content, restrict access, or suspend accounts or events that violate these Terms or create legal, safety, operational, or reputational risk.
12. Third-Party Services
The Services may rely on or integrate with third-party providers such as cloud storage providers, AI model providers, analytics tools, email delivery providers, payment processors, and authentication services.
Those third-party services are governed by their own terms and policies. PBFX is not responsible for third-party services or for failures caused by third-party infrastructure outside our reasonable control.
13. Privacy
Your use of the Services is subject to our Privacy Policy and any other privacy notices we provide in connection with the Services.
Because PBFX may be used in event environments, some privacy outcomes depend on how the host or operator configures the experience. Event gallery visibility, email capture, access links, and sharing behavior may differ by event.
14. Availability, Changes, and Beta Features
We may modify, suspend, or discontinue any part of the Services at any time.
Some features may be labeled beta, pilot, preview, or experimental. Those features may change more often, may be less stable, and may be removed at any time.
We are not obligated to continue any feature, event flow, gallery type, or retrieval method.
15. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PBFX DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICES WILL BE ERROR-FREE, UNINTERRUPTED, SECURE, OR THAT GENERATED CONTENT WILL MEET YOUR EXPECTATIONS.
AI-generated outputs may contain inaccuracies, inconsistencies, or unexpected results. You are responsible for reviewing outputs before using, publishing, distributing, or relying on them.
16. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, PBFX AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, DATA, OR USE, ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, PBFX'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).
Some jurisdictions do not allow certain disclaimers or limitations, so portions of this section may not apply to you.
17. Indemnification
You agree to indemnify, defend, and hold harmless PBFX and its officers, directors, employees, contractors, affiliates, licensors, and service providers from and against any claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:
your use of the Services
your User Content
your violation of these Terms
your violation of any law or third-party right
if you are an organizer, host, operator, school, or entity customer, your event configuration, notices, permissions, or participant management decisions
18. Suspension and Termination
We may suspend, restrict, hide, or terminate access to the Services, an event, a gallery, an account, or specific content at any time, with or without notice, if we reasonably believe:
these Terms were violated
access is unauthorized
the Services are being misused
content creates privacy, legal, safety, or operational risk
removal or restriction is necessary to protect users, event participants, PBFX, or third parties
Upon termination, any license granted to you to use the Services ends immediately.
19. Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to conflict of laws principles.
Except to the extent arbitration is adopted in a final published version, any dispute arising out of or relating to these Terms or the Services will be brought in the state or federal courts located in Contra Costa County, California, and you consent to that jurisdiction and venue.
20. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date. If changes are material, we may provide additional notice.
Your continued use of the Services after updated Terms become effective means you accept the revised Terms.
