Terms of Sale — Photo Booth FX (“PBFX”)

These Terms of Sale (“Terms of Sale”) govern purchases of digital goods, licenses, subscriptions, and services (collectively, “Products”) from Photo Booth FX (“PBFX,” “we,” “us”) via pbfx.ai and our store (the “Site”). By placing an order, you agree to these Terms of Sale, our Terms of Use, Privacy Policy, Cookie Policy, Your Privacy Choices, and our Digital Goods & Licensing Disclosure (incorporated by reference).

1) Products Offered

PBFX primarily offers digital prompts, presets, templates, documentation, and related downloadable or streamable content, plus optional services (e.g., support, configuration) and subscriptions. All digital purchases are licenses, not sales of the underlying content.

2) Pricing, Taxes, and Errors

  • Prices are shown in the currency indicated at checkout and may change at any time before you place an order.

  • We may collect and remit applicable taxes (e.g., U.S. state sales tax, VAT/GST) where required. If not collected, you are responsible for any use or value-added taxes due.

  • We try to be accurate, but errors may occur. If we discover a pricing or availability error, we may cancel or refuse an order; we’ll notify you and issue a full refund for any amounts charged.

3) Order Process & Contract Formation

Your order is an offer to buy. We accept only when we send an order confirmation or provide access to your digital item/subscription—whichever occurs first. We may decline or cancel an order (e.g., suspected fraud, licensing conflicts, or where service is unavailable in your region); if we’ve charged you, we’ll refund in full.

4) Delivery of Digital Goods

Digital Products are typically delivered by download link, account access, or email promptly after payment. Please download and securely store your files. Access links may expire or be rate-limited to prevent abuse.

5) License to Digital Goods (Read Carefully)

Unless your order page states otherwise, PBFX grants you a non-exclusive, non-transferable, non-sublicensable license to use the purchased digital prompts/presets/templates to create client outputs for your business or personal projects.

You may not:

  • Resell, sublicense, share, or distribute PBFX prompts, presets, templates, or other digital source assets.

  • Reverse engineer or attempt to reconstruct PBFX prompts or internal logic from outputs.

  • Use any PBFX content to train, fine-tune, evaluate, or fingerprint AI models, or to build datasets, embeddings, or feature extraction pipelines.

  • Remove copyright or licensing notices or use PBFX materials in a manner that suggests sponsorship or endorsement.

Ownership. PBFX retains all rights in the digital goods and underlying IP. You own your outputs (images, renders, files you produce) subject to third-party rights and any platform/model terms beyond our control. Nothing here transfers PBFX’s IP ownership.

6) Subscriptions & Auto-Renewals (if offered)

Some Products are sold by subscription (e.g., updates, support, gated libraries):

  • Billing & Term. You’ll be billed at the stated interval until you cancel.

  • Renewals. Subscriptions auto-renew unless canceled before the renewal date. We may change pricing or features for future terms with notice.

  • Cancellation (“Click to Cancel”). You can cancel anytime online via Manage Subscription / Cancel in our footer (California BPC §17602 compliant). Cancellation stops future charges; access continues through the paid term.

  • Refunds on subscriptions. Unless otherwise stated, subscription fees are non-refundable after the term begins, except where required by law.

7) Trials, Coupons, and Promotions

Trials run for the period stated on the offer; after the trial, regular billing begins unless you cancel. Promotions and coupon codes have eligibility limits, cannot be combined unless we say so, and don’t apply retroactively.

8) Refunds & Right of Withdrawal

Digital content (downloads/streaming). Because access is delivered immediately, all sales are final once you: (a) access the download, or (b) otherwise receive the content. In EU/UK jurisdictions, you may have a 14-day right of withdrawal for distance sales, but it does not apply to digital content once you expressly agree that delivery starts immediately and acknowledge you lose the right to withdraw. We implement that consent at checkout where applicable.

Defective or misdescribed items. If a digital file is corrupted, links fail, or the item materially differs from the description, contact us within 14 days of purchase. We’ll repair/replace the file or issue a refund if we cannot remedy the issue.

Services. For booked services, cancellation/refund terms will be stated at purchase or in the service agreement.

9) Payment & Chargebacks

Payments are processed by third-party providers (e.g., Stripe, PayPal). By purchasing, you authorize us (or our processor) to charge your selected payment method.
Chargebacks. Please contact us first—most issues are fixable. Unwarranted chargebacks on valid deliveries may result in license revocation and account restrictions.

10) Updates, Access Changes, and Discontinuation

We may modify or update digital goods (bug fixes, improvements) and, where applicable, provide updates during your subscription window. We may discontinue legacy items or retire download links for security and anti-abuse; keep local backups of your purchases.

11) Export Controls & Sanctions

You must comply with applicable export and sanctions laws. Do not purchase or use PBFX Products where such use is prohibited by U.S. or international sanctions.

12) Warranties & Disclaimers

PBFX provides Products “as is” and “as available.” To the fullest extent permitted by law, PBFX disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not guarantee specific creative outcomes, platform approvals, or third-party rights clearances (e.g., logos, likenesses).

13) Limitation of Liability

To the fullest extent permitted by law, PBFX will not be liable for indirect, incidental, special, consequential, or punitive damages; or lost profits, revenues, data, or use, arising from your purchase or use of the Products. PBFX’s aggregate liability for any claim will not exceed the amount you paid for the Product giving rise to the claim in the 12 months before the event.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply.

14) Indemnity

You agree to indemnify and hold PBFX harmless from claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of: (a) your misuse of Products; (b) violation of these Terms of Sale or license restrictions; or (c) your outputs’ infringement of third-party rights.

15) Governing Law; Disputes

These Terms of Sale are governed by California law (without regard to conflict-of-laws rules). Venue lies in the state or federal courts in Contra Costa County, California.
Optional Arbitration / Class Waiver. If your Terms of Use include arbitration, that clause applies to purchases as well.

16) Changes to These Terms of Sale

We may update these Terms of Sale at any time. Changes apply to purchases made after the effective date. For subscriptions, we’ll notify you of material changes in advance; continued use after changes take effect constitutes acceptance.
